Low Expectations
Some (Holy Fool, CAEI, etc.) have taken note that the follow-up for something I mentioned in passing a couple of months ago is rapidly approaching, namely that the Supreme Court will be revisiting in a New Hampshire case the "health" exception requirement established by still sitting Justice O'Connor. The same issue may be addressed again in the spring when the court could consider the appeals of New York, California, and Nebraska judgments against partial-birth abortion bans. As Holy Fool notes, "Now, we begin to see how devoted to Strict Constructionism Justice Roberts truly is."
